These Terms are an agreement between you and Datawizz Inc., a Delaware corporation ("DialMCP," "we"). By verifying a phone number or connecting DialMCP to an AI client, you accept them.
1. The service
DialMCP lets you direct an AI assistant, through an MCP-compatible AI client, to place outbound phone calls on your behalf and from your own verified phone number, and returns transcripts, recordings, and structured results. You are the caller: calls are placed at your direction, one task at a time, and your real number is shown to the callee. The service currently places calls to United States and Canada numbers only.
DialMCP is in a pilot/early-access period: it is free of charge, limits are conservative, and features and limits may change. We may introduce pricing later with notice.
2. Eligibility and your account
- You must be 18 or older and able to form a binding contract.
- You may only verify a phone number you own or control. Verification is by SMS code; your number is your identity and your caller ID.
- Because possession of your number is what authenticates you, you are responsible for maintaining control of your number and SIM. Tell us promptly at [email protected] if you lose control of it.
- Calls placed through any AI client connected to your account are your calls, whether you typed the instruction yourself or your agent generated it. Configure your agents accordingly, and disconnect the connector to revoke access at any time.
3. Acceptable use
You agree that you will:
- only direct calls you would be entitled to make yourself, to parties you have a legitimate reason to contact;
- not use the service for telemarketing, cold outreach, robocalling campaigns, surveys, lead generation, debt collection, or political outreach, or for any call requiring prior express written consent under the TCPA or equivalent state law;
- not use it to harass, threaten, stalk, defraud, or deceive anyone, to impersonate any person or institution, to extract private data about third parties, or to contact emergency services;
- not attempt to make the assistant conceal that it is an AI, skip the recording disclosure, or otherwise defeat the safety behavior described in §4;
- comply with the laws of your jurisdiction and the callee's.
We screen objectives before dialing and refuse those that appear to violate these rules. Screening is a backstop, not permission: passing the screen does not make a call lawful or permitted.
4. What the service does on every call
The following is built-in, server-enforced behavior — not model instructions an agent can ignore, and not settings you can switch off:
- the assistant identifies itself as an AI assistant calling on your behalf and states that the call is recorded, before pursuing your objective — and it never denies being an AI;
- verbal opt-outs by callees ("don't call again") are honored permanently and service-wide, and anyone can block their number at mcp.dialmcp.com/opt-out;
- calls are permitted only 8:00–21:00 in the destination's local time;
- rate limits apply: 1 concurrent call, 3 calls/hour, 10 calls/day, and 2 calls/day to any one destination number, plus burst limiting;
- calls are capped in duration (6 minutes by default, 10 minutes hard cap);
- emergency numbers (911, 988), premium-rate numbers (900/976), and non-US/CA destinations are blocked and cannot be overridden;
- the destination's line type is checked and a compliance record is kept for every call;
- if a call reaches voicemail, the assistant hangs up without leaving a message.
We may change these limits, refuse any objective, suspend accounts, or pause the service entirely at our discretion. Abuse of a system that places real phone calls reflects on every user's number, so we err on the side of refusing.
5. Recording, consent, and compliance
- Every answered call is recorded and transcribed, and opens with a recording disclosure designed for all-party-consent states. You instruct the recording by placing the call, and you are responsible for the legality of the call and its recording in your specific context.
- You consent to your verified number being displayed as the caller ID for calls you direct.
- You acknowledge that calls to wireless numbers are subject to the TCPA; the service is designed for individual, user-initiated, non-marketing tasks — the kind of call you could lawfully dial yourself — and you agree to use it only that way.
6. Your content
You own your objectives, and the transcripts, recordings, and results of your calls. You grant us a license to store and process this content to operate the service, enforce these Terms, and comply with law, as described in the Privacy Policy. We do not use your call content to train AI models.
7. Disclaimers
- The assistant is an AI: it can mishear, misunderstand, be misled by the person it is talking to, or fail to achieve your objective. Verify anything that matters (confirmation numbers, appointments, prices, commitments) from the transcript or recording before relying on it.
- The service cannot be used to contact emergency services and is not a substitute for them.
- The service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that calls will connect, complete, or be error-free.
8. Liability and indemnity
To the maximum extent permitted by law:
- our aggregate liability for all claims relating to the service is capped at the greater of US $100 or the amount you paid us in the past 12 months;
- we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits;
- you will indemnify us against third-party claims (including TCPA, recording-consent, and harassment claims) arising from calls you direct in violation of §3 or §5.
9. Suspension and termination
You may stop using the service and close your account at any time ([email protected]). We may suspend or terminate your access at any time for any reason, including suspected abuse — with notice where practicable. Sections 5–11 survive termination. Do-not-call suppressions survive everything, by design.
10. Governing law, arbitration, and class-action waiver
Governing law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The Federal Arbitration Act governs the arbitration provisions below.
Informal resolution first. Before starting arbitration or filing any claim, you agree to email [email protected] with a description of the dispute and give us 30 days to resolve it with you.
Binding arbitration. Any dispute arising out of these Terms or the service that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in English by videoconference or in the county where you live. Fees are allocated per the AAA consumer rules; judgment on the award may be entered in any court of competent jurisdiction. Either party may instead bring an individual claim in small-claims court, and either party may seek relief in court for intellectual-property infringement or misuse of the service. Claims for public injunctive relief under California law may be pursued in court.
Class-action waiver. Disputes will be resolved on an individual basis only. Neither party may participate in a class, consolidated, or representative action, and both parties waive the right to a jury trial. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) proceeds in court, and the rest remain in arbitration.
Your right to opt out. You may opt out of this arbitration agreement and class-action waiver — with no effect on your ability to use the service — by emailing [email protected] within 30 days of first accepting these Terms, stating your name, your verified phone number, and that you opt out of arbitration.
Venue. For any dispute not subject to arbitration, both parties consent to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.
11. Changes
We may update these Terms. For material changes we will give notice (on the site or via the service); continued use after the effective date is acceptance.
